Privacy Advocate Caught Red Handed. Again.

Staff attorney for the Electronic Frontier Foundation Kevin Bankston has been caught by Google's Street View camera having a cigarette on his way to work - a habit he's been trying to conceal from his family. Here's a picture of him for comparison.
In a brilliant case of history repeating itself, it turns out that Kevin was actually previously caught having a sneaky smoke back in 2005, this time by Amazon's A9 service!

I recently celebrated my 6 month non-smoking anniversary after 25 years of the demon weed, all I can say is Kevin pack it in mate, it doesn’t seem to be working for you. I found it easy, you just have to make the decision that you don’t smoke anymore, then when you feel like one, you can’t because you don’t smoke anymore so you just have to find something else to do with your hands, I know what your all thinking but NO. I found a rubiks cube very handy for the first 2 weeks and GGSS of course.
I’ll be on 20 months on the 21st of this month. Without a doubt the best thing i ever done. Food tastes so good now!

What’s more likely, a leading digital privacy attorney happens to be caught twice on film thus proving the point he’s fighting against, or the whole thing is completely staged to gain publicity for is point?
It’s millions of times more likely that this was all staged and is a complete, utter lie.
